Terms of Service

These Terms of Service apply to the HAiCook mobile application (hereinafter referred to as the "App") provided by YEN JUNG SU, an individual developer based in Taiwan (hereinafter referred to as the "Provider" or "we"). Please read these terms carefully before using the App. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

The App, including all content, technology, trademarks, and intellectual property contained therein, is owned and legally protected by YEN JUNG SU. No part of the App may be used or reproduced without authorization.

1. Intellectual Property and Prohibited Conduct

The Provider owns all intellectual property rights related to the HAiCook App, including its content, features, technologies, trademarks, designs, texts, images, audio, databases, and source code.

HAiCook is an AI-powered recipe generation and meal planning application that helps users:

Users may not:

• Copy, modify, reverse engineer, decompile, decode, or otherwise attempt to access the source code of the App.
• Business Transfers: In the event of a merger, acquisition, or asset sale, your data may be transferred as part of that transaction.
• Translate, reproduce, resell, rent, or create derivative works related to the App.

Violation of any of the above may result in account suspension or termination, and the Provider reserves the right to pursue legal remedies.

Strictly Prohibited Conduct：

1-1. Unauthorized Commercial Use of AI Content

You may not, without written consent, use any AI-generated content (such as recipes, ingredient combinations, nutritional advice, or images) from the App for commercial purposes, including but not limited to：

• Reselling or sublicensing generated content.
• Including content in paid offerings on your own or third-party platforms.
• Integrating content into other commercial apps or websites.
• Using AI recipes in physical publications, subscription services, or advertisements.

1-2. Spreading Misleading Health Information or Impersonating Professional Advice

Content from the App is for reference only and does not constitute medical or nutritional advice. You may not：

• Present AI-generated recipes or suggestions as advice from professionals or institutions.
• Share false or misleading dietary information on public or social platforms.
• Claim any recipe provides therapeutic, health, or medical benefits under the name of HAiCook.

HAiCook is not liable for health issues or legal disputes caused by such conduct and reserves the right to terminate the offending account.

1-3. Abuse of System Resources or Automation

To ensure fair use and system stability, you may not:

• Use automated tools, bots, or scripts (e.g., Selenium, Puppeteer) to mass-generate or access recipes.
• Create multiple accounts to exploit free quotas or bypass usage limits.
• Use external tools to mimic user behavior or circumvent app protections to extract data or trigger API calls.
• Perform repeated actions (generation, browsing, uploads) at abnormal speeds or frequencies.

If abnormal behavior is detected, HAiCook reserves the right to suspend or terminate accounts without refund or reinstatement.

1-4. Posting Hateful, Violent, Obscene, False, or Illegal Content

You may not post or transmit the following via the HAiCook platform (e.g., Cooksnap posts, usernames, or other user-generated content)：

• Discriminatory, hateful, violent, or sexually suggestive language or imagery.
• Illegal content or content infringing on copyrights, reputation, likeness, or privacy.
• Malicious links, viruses, or phishing websites.
• Impersonation or dissemination of false identities or information.

HAiCook may review and remove violating content and impose penalties ranging from account suspension to permanent bans or legal action.

2. Services Provided

HAiCook is an AI-powered intelligent recipe app that supports users with daily meal planning and cooking. Services include:

• Unlocking and browsing recipes using consumption-based credits.
• Generating personalized recipes using AI.
• Saving favorite recipes for quick access.
• Adding ingredients to a shopping list.
• Sharing and viewing Cooksnap photos and comments.
• Scheduling cooking plans.
• Receiving weekly recipe recommendations.
• Setting dietary preferences (e.g., diet type, allergens, avoid ingredients).
• Offering two premium models: subscription and one-time credit purchase.

HAiCook combines everyday cooking support with personalized recommendations and community interaction to enhance your culinary lifestyle.

3. AI Content Disclaimer

Some recipes, nutrition information, or suggestions in the App are automatically generated by AI and are for reference only. They do not constitute professional medical or nutritional advice. Users should exercise discretion and consult professionals as needed. See the full disclaimer：AI Recipe Disclaimer.

4. User-Generated Content

• Users retain copyright of content they create or publish (e.g., shared recipes, Cooksnaps).
• By uploading content, users grant HAiCook a non-exclusive, global, perpetual, royalty-free license to use the content for display, promotion, and internal analysis.
• Even if an account is deleted, public content may be retained to preserve platform integrity but will have personal identifiers removed or anonymized.

5. One-Time Purchases (View/Generate Credits)

• These are single-use digital services delivered immediately after purchase, whether made via App Store or Google Play.
• In accordance with EU consumer protection laws (Directives 2011/83/EU and 2019/770/EU), you agree to the immediate delivery of digital content and waive the 14-day withdrawal right once the transaction is completed.
• Credits are non-transferable, non-refundable, and non-exchangeable for cash, even if unused.

6. Subscription Terms

• HAiCook subscriptions may be processed through Apple App Store or Google Play.
• HAiCook offers two subscription plans: Basic Plan and Premium Plan. All subscriptions are on a monthly auto-renewal basis. If you do not wish to renew, you must cancel your subscription at least 24 hours before the next billing cycle through the original platform (e.g., App Store or Google Play).
• Once confirmed, the subscription is considered active. For users in the EEA, you agree to the immediate delivery of digital content and waive your 14-day right of withdrawal.
• After cancellation, you may continue to access paid features until the end of the current subscription period.
• All purchases and subscriptions are processed through the Apple App Store or Google Play. HAiCook does not process payments and therefore cannot directly issue refunds. For more information about refund procedures, please refer to the FAQ section.

7. Advertisements

All advertisement content, including descriptions, text, images, display samples, or other promotional information you see in this service, is designed and provided by the respective advertisers or suppliers of the products and services. You should evaluate and judge the accuracy and reliability of such advertisements at your own discretion. HAiCook only publishes advertisements upon request and does not provide any guarantees or assume responsibility for the content of these advertisements.

8. Device & Connectivity Responsibility

• Users are responsible for ensuring device security and stable internet connectivity.
• Jailbreaking or rooting is discouraged, as it may cause security issues or malfunction.
• HAiCook is not liable for service interruptions caused by power loss, connection failure, or client-side issues.
• International data roaming fees are the user's responsibility.
• The App may involve cross-border transmission of personal data. For more details, see our Privacy Policy.

9. Updates & Termination

• The App may be updated at any time. Users must install updates to continue using the service.
• The Provider reserves the right to modify, suspend, or terminate the App at any time without prior notice.
• Upon termination, your license ends and you must immediately stop using and delete the App.

10. Governing Law & Dispute Resolution

• These Terms shall be governed by the laws of Taiwan (R.O.C.) without regard to conflict of law principles. Any disputes arising from these Terms or the services will first be resolved through negotiation. If unresolved, both parties agree to submit to the Taipei District Court (or other Taiwan courts of competent jurisdiction) as the exclusive court of first instance.
• EU users may raise claims under the consumer protection laws of their country of residence.

11. User Responsibility and Platform Disclaimer

If you provide, upload, or transmit any content through the App (including but not limited to recipes, images, comments, Cooksnaps, etc.), or if you violate these Terms of Service or infringe upon the rights of any third party (such as copyright, trademark, privacy, or personality rights) during your use of the HAiCook services, and such actions result in any claims, demands, or legal actions against the Provider, you agree to take full responsibility. You further agree to indemnify and hold harmless HAiCook, its affiliates, officers, employees, partners, and licensors from any damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees).
